If I file for divorce, do I need to hire an attorney?
No.  Many legal matters do not necessarily require the services of an attorney, and divorce (now called "Dissolution of Marriage") is an example.  More than half of all divorce cases in California are now filed in pro per (i.e., without representation).

If I don't need an attorney, why should I hire a legal document assistant?
Although a legal document assistant cannot give legal advice, we have the knowledge, experience, and understanding needed to complete all of the paperwork.  Even an uncontested case can be complex and difficult to manage without professional assistance.

How long does it take for a divorce to be finalized in California?
The divorce procedure in California takes six months from the date the Respondent (the spouse) is served.

Can I get a "quickie" divorce from Mexico?
No.  California does not recognize a divorce from Mexico or the Dominican Republic unless one of the parties resides in that country at the time of filing.

Can I file for divorce in Las Vegas, where I was married?
No.  You must file in the state where you reside, not in the state where you got married.

How much child support am I entitled to receive?
If both parties can agree on a specific amount, the court generally accepts that figure.  Otherwise, child support is calculated based on both parties' incomes and the proportion of time the children spend with each parent.  Please call us if you would like a computer calculation.

Are there circumstances in which attorney representation might be needed for a divorce procedure?
Attorneys are needed for cases in which the parties cannot agree on such issues as child custody or division of assets.  You also might wish to have an attorney for legal advice, representation, or to inform you of your rights.  These are services a legal document assistant cannot provide.

I'm not filing for divorce, so what can you do for me?

What is SB 1418 and how does it affect me?
In brief, SB 1418 protects you, the consumer, against unqualified persons presenting themselves as paralegals or legal document assistants (LDAs).  As you shop for self-help legal services, feel free to request the person's registration number (my registration number is 0007, Los Angeles County, expiration 4/2/2006).  There are still some unscrupulous practitioners who are not registered--so please be aware and protect yourself.
